- A KC Life Century II VUL policy owner, J. Gregory Sheldon, sued KC Life over cost of insurance and expense charges deducted from policy owners’ contract values.
- The Court has allowed the lawsuit to proceed as a class action on behalf of all current and former Missouri Century II VUL policy owners, subject to certain exclusions.
- Trial commenced on September 18, 2023, and on September 21, 2023, the jury returned a verdict in favor of the Plaintiffs on their breach of contract claims against Kansas City Life and found damages in the amount of $4,095,897.75. It is expected that Kansas City Life will appeal after the conclusion of post-trial briefing and once a judgment is entered, but it is difficult to predict when the appellate court might decide the appeal.
